The legislation is reminiscent of the Analog Content Security Preservation Act, a suggested piece of draft legislation pushed by the RIAA last year.

In each case, the H.R. 4861 bill would allows broadcasters to "flag" all or portions of their broadcasts with the ability to block recording of the songs or discussion. Players would need to be fitted with technology essentially placing the content in the hands of the braodcasters.

"The idea is the flag language would be included in licensing agreements between Ibiquity and receiver manufacturers and between the satellite radio companies and their receiver partners, said a staffer for Rep. Ferguson," Radio World reported. Co-sponsors are Rep. Edolphus Towns, D-N.Y., Rep. Mary Bono, R-Calif., Rep. Bart Gordon, D-Tenn., and Rep. Marsha Blackburn, R-Tenn, the paper reported.

The bill has yet to be heard.
